ANALYSIS OF THE JUDGMENT CASE GOGIĆ v. HRVATSKA

The judgement of Oct 8th 2020 was rendered by which the Court found a violation of Art. 6 § 1 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

 

 

The judgment found that his right of access to a court, guaranteed by the Convention, had been violated by the erroneous legal qualification and instruction given by the lower courts to the party, which had rendered his claim out of time.
